32Red wins trademark victory against William Hill
High Court has ruled on (Jan 21) in favor of 32Red casino for the company’s trademark dispute going lately between this online gambling operator and another Online Casino familiar with the name of 32Vegas online casino i-e Owned by William Hill.
32Red claimed the trademark infringement and by stating the court’s decision, it said that the owner of 32Vegas online casino has used the “32 Vegas and “32 V” which has infringed the 32Red EC registered trademark and it may lead the he customers to the confusion.
The court has already dismissed a counter-claim made by William Hill in which he challenged the validity of 32Red’s trademark rights in the UK and European Community.
According to 32Red court should be asked for an injunction to avoid the usage of 32Vegas marks in the entire European Community. Besides that it would even ask for the repayment of the legal costs paid by it plus the inquiry should be carried on to assess the extent of the damage s or profits arising from the infringement of the already registered trademark. Although, It was not yet possible to quantify the financial impact of the court result.
According to CEO Ed Ware that they are naturally delighted that the High Court has upheld their claims. This judgment by the court has firmly established our intellectual property rights and should deter other operators from infringing their trade marks. As described by the judge, they already have an excellent reputation when it comes to operate an online casino and a strong brand – these are extremely valuable assets in any marketplace.
